Terms of Service — Custom Backup

Welcome to Custom Backup ("CB", "we", "our", or "us"). Custom Backup is an online learning platform that enables users to create, share, and study digital learning resources ("Custom Steps (study sets)"), powered by algorithms such as SM-2+ and visual tools like Backup Blocks (progress tracker).

By using Custom Backup, you ("you", "user", or "student") agree to these Terms of Service. If you do not agree, you must stop using the platform immediately.

• You must be at least 13 years old to use CB.
• If you are under 18 years old, you must have parental/guardian permission to use the service.
• The legal operator of this platform is Custom Backup Limited, a company registered in England and Wales (Company Number: 16677821).
• Until the founder reaches the age of 18, the company is administered under guardian oversight.

• You are responsible for keeping your login credentials secure.
• You must not share your account or impersonate another user.
• We reserve the right to suspend or terminate accounts that violate these Terms.

• Custom Steps (study sets) → User-generated collections of study cards.
• Levels → Study runtime experiences powered by SM-2+.
• Backup Blocks (progress tracker) → Visual memory state tracking.
• AI CustomBro → Optional AI enhancements for creating and marking content.

We may update or discontinue features at any time.

• CB offers four tiers: Free, Plus, Pro, CASES.
• Each tier has defined upload limits, features, and AI usage quotas.
• Payment functionality will be introduced in a future version.
• Pricing, billing, and refund terms will be updated at that time in accordance with UK consumer law.

You are fully responsible for all content you upload. You must not upload:

• Content that infringes the rights of others, including copyrighted materials.
• Textbook scans, copyrighted exam papers, or proprietary decks from other platforms.
• Illegal, harmful, or abusive content.

When publishing a Custom Step (study set), you must choose one of the following licences:

1. All Rights Reserved (ARR) → Others may only view/play privately, no edits or republishing.
2. CC-BY-NC → Others may clone, edit, and republish non-commercially with attribution.
3. CC-BY → Others may clone, edit, and republish commercially with attribution.

You may not misrepresent the licence chosen by another user.

• The CB platform itself, including SM-2+ scheduling logic, Backup Blocks (progress tracker), UI design, AI CustomBro, and branding, is the exclusive property of Custom Backup Limited.
• You may not copy, reverse engineer, or create derivative works of the CB platform.

We may suspend or terminate your account without notice if:

• You breach these Terms.
• You engage in misuse, fraud, or illegal activity.

You may terminate your account at any time by deleting it in your profile settings.

• CB is an educational tool. We do not guarantee exam results or academic outcomes.
• CB is provided "as is" without warranty.
• We are not responsible for:
  • Platform downtime.
  • Loss of data.
  • Failures of third-party providers (Supabase, Cloudinary, OpenAI, SendGrid).

• We collect and process personal data in accordance with our Privacy Policy.
• Data may be stored and processed by trusted third-party providers:
  • Supabase → authentication & database.
  • Cloudinary → media hosting.
  • OpenAI → processing of text entered into AI-powered features.
  • SendGrid → transactional email delivery (e.g. sign-up, notifications).

These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

We may update these Terms at any time. Updates will be posted on this page with a new "Effective Date." Continued use of CB after changes means acceptance of the new Terms.
