Terms of Service - Custom Backup
Effective Date: 2 October 2025
1. Introduction
Welcome to Custom Backup ("CB", "we", "our", or "us"). Custom Backup is an online learning platform that enables users to create, share, and study digital learning resources ("Custom Steps (study sets)"), powered by algorithms such as SM-2+ and visual tools like Backup Blocks (progress tracker).
By using Custom Backup, you ("you", "user", or "student") agree to these Terms of Service. If you do not agree, you must stop using the platform immediately.
2. Eligibility
- You must be at least 13 years old to use CB.
- If you are under 18 years old, you must have parental/guardian permission to use the service.
- The legal operator of this platform is Custom Backup Limited, a company registered in England and Wales (Company Number: 16677821).
3. Accounts
- You are responsible for keeping your login credentials secure.
- You must not share your account or impersonate another user.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Services Provided
- Custom Steps (study sets) → User-generated collections of study cards.
- Levels → Practice sessions powered by SM-2+.
- Backup Blocks (progress tracker) → Visual memory state tracking.
- Custom AI → Optional AI enhancements for creating, explaining, summarising and marking content.
We may update or discontinue features at any time.
5. Subscriptions, Payments & Refunds
5.1 Subscription Plans
CB offers three subscription tiers:
- FREE → Limited features with basic AI usage quotas.
- PLUS → £4.99/month with enhanced AI features and unlimited markers.
- PRO → £11.99/month with maximum AI quotas, unlimited markers, and access to The Custom Distinctions.
Each tier has defined upload limits, features, and AI usage quotas as detailed on our pricing page.
5.2 Payment Processing
- Payment Processor: All payments are processed securely by Stripe, our sole payment provider.
- Payment Data: CB does not store or have access to your card details. Stripe handles all payment information securely in compliance with PCI DSS standards.
- Accepted Methods: Credit cards, debit cards, and other payment methods supported by Stripe.
5.3 Billing & Auto-Renewal
- Billing Cycle: Subscriptions are billed monthly from the date you subscribe.
- Auto-Renewal: Your subscription will automatically renew each month unless cancelled before the renewal date.
- Payment Failures: If payment fails, your subscription may be suspended until the issue is resolved.
- Price Changes: We reserve the right to change subscription prices with at least 30 days' notice.
5.4 Managing & Cancelling Subscriptions
- Stripe Customer Portal: You can manage your subscription (update payment methods, view invoices, cancel) via the Stripe Customer Portal accessible from your account settings.
- Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period.
- Downgrade to FREE: Upon cancellation, your account will automatically downgrade to the FREE plan when your paid period ends. You will retain access to paid features until the end of the billing period.
- No Partial Refunds: If you cancel mid-cycle, you will not receive a refund for the remaining days of your billing period.
5.5 Plan Upgrades & Downgrades
- Upgrades: When upgrading (e.g., FREE to PLUS, or PLUS to PRO), you will be charged immediately and your billing cycle will restart.
- Proration: Stripe automatically handles proration when you upgrade or downgrade mid-cycle. You will be charged or credited the difference based on the time remaining in your current period.
- Downgrade via Portal: Downgrades are also handled through the Stripe Customer Portal and takes effect at the end of your current billing period.
5.6 Refund Policy
NO REFUNDS UNDER ANY CIRCUMSTANCES
All subscription payments are non-refundable. This includes but is not limited to:
- Dissatisfaction with the service.
- Failure to use the subscription during the billing period.
- Accidental purchases or duplicate subscriptions.
- Cancellation mid-cycle (you retain access until the end of the paid period, but no refund is issued).
By subscribing to PLUS or PRO, you acknowledge and agree that all payments are final and non-refundable.
5.7 Quota Resets
- Monthly Limits: AI usage quotas (CB Create, CB Notes, CB Images, CB Explanation) and CB Markers reset on your billing cycle date each month.
- No Carry-Over: Unused quotas do not roll over to the next billing period.
- Hard Reset: All quota counters reset to zero at the start of each new billing cycle.
6. User Content
6.1 Ownership
- All Custom Steps (study sets) and content you upload remain yours.
- CB does not claim ownership of your intellectual property.
6.2 License to CB
By uploading content, you grant CB a worldwide, non-exclusive licence to store, process, and display your content solely to provide the service.
6.3 Responsibility
You are fully responsible for all content you upload. You must not upload:
- Content that infringes the rights of others, including copyrighted materials.
- Textbook scans, copyrighted exam papers, or study sets from other platforms.
- Illegal, harmful, or abusive content.
7. Licensing of Custom Steps (study sets)
When publishing a Custom Step (study set), you must choose one of the following licences:
- All Rights Reserved (ARR) → Others may only view/play privately, no edits or republishing.
- CC-BY-NC → Others may clone, edit, and republish non-commercially with attribution.
- CC-BY → Others may clone, edit, and republish commercially with attribution.
You may not misrepresent the licence chosen by another user.
8. Custom Backup Intellectual Property
- The CB platform itself, including the algorithms used in the Levels (e.g. SM-2+ scheduling logic), Backup Blocks (progress tracker), UI design, Custom AI, logos,and branding, is the exclusive property of Custom Backup Limited.
- You may not copy, reverse engineer, or create derivative works of the CB platform.
- The product explainer video, soundtrack, voiceover, and all associated promotional media displayed on this website are the sole intellectual property of Custom Backup Limited.
- These assets were created in-house and are protected under UK copyright law and international IP treaties. You may not copy, modify, redistribute, or reproduce any portion of these media assets without prior written consent from the company.
- This clause does not apply to user-generated content created via the platform (e.g. CB Images, CB Create outputs, or manual image uploads). Those assets remain under the ownership of their respective creators, subject to our platform’s licensing terms.
9. Termination of Accounts
We may suspend or terminate your account without notice if:
- You breach these Terms.
- You engage in misuse, fraud, or illegal activity.
You may terminate your account at any time by deleting it in your profile settings.
10. Liability Disclaimer
- CB is an educational tool. We do not guarantee exam results or academic outcomes.
- CB is provided "as is" without warranty.
- We are not responsible for:
- Platform downtime.
- Loss of data.
- Failures of third-party providers (Supabase, Cloudinary, OpenAI, Resend, Stripe).
11. Data Protection & Privacy
- We collect and process personal data in accordance with our Privacy Policy.
- Data may be stored and processed by trusted third-party providers:
- Supabase → authentication & database.
- Cloudinary → media hosting.
- OpenAI → processing of text entered into AI-powered features.
- Resend → transactional email delivery (e.g. sign-up, notifications).
- Stripe → payment processing (card details, billing address, transaction history).
12. Governing Law
These Terms are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
13. Changes to These Terms
We may update these Terms at any time. Updates will be posted on this page with a new "Effective Date." Continued use of CB after changes means acceptance of the new Terms.
